DISMISSED CASE AGAINST REGISTERED NURSE

Client, a Licensed Registered Nurse, was accused by the Board of Registered Nursing of unprofessional conduct for allegedly striking a patient and preventing her from receiving a phone call. (OAH No. 2018-08-0702) For these alleged offenses the Board sought revocation of her license.

Ultimately the case went to hearing at the Office of Administrative Hearings in Oakland, California, at which time the state presented their case. Our case relied exclusively on the cross examination on the states witnesses. After hearing the court found the prosecutions expert witness was not credible and the substantive accusation of assault lacking.
